Where are the regulations on procedures for issuing criminal record certificate No. 01 for foreigners carried out?

Pursuant to Article 45 Law on Judicial Records 2009 Some provisions are repealed by Clause 4, Article 37. Residence Law 2020 Regulations on granting criminal records to foreigners residing in Vietnam are as follows:

1. Procedures for requesting Criminal Record Certificate No. 1

1. The person requesting a Criminal Record Certificate submits a Criminal Record Certificate Request Form and attaches the following documents:

a) A copy of the identity card or passport of the person to whom the Criminal Record Certificate is issued;

2. Individuals submit the Application for a Criminal Record Certificate and accompanying documents to the following agencies:

a) Vietnamese citizens submit to the Department of Justice where they permanently reside; in case they do not have a permanent residence, they submit to the Department of Justice where they temporarily reside; in case they reside abroad, they submit to the Department of Justice where they resided before leaving the country;

b) Foreigners residing in Vietnam submit to the Department of Justice where they reside; in case they have left Vietnam, submit to the National Center for Judicial Records.

3. Individuals may authorize another person to carry out the procedures for requesting a Criminal Record Certificate. The authorization must be made in writing in accordance with the provisions of law; in case the person requesting a Criminal Record Certificate is the father, mother, wife, husband or child of the person to whom the Criminal Record Certificate is issued, no authorization document is required.

4. When requesting to be issued a Criminal Record Certificate, the agencies and organizations specified in Clause 3, Article 7 of this Law shall send a written request to the Department of Justice where the person to whom the Criminal Record Certificate is issued has permanent or temporary residence; in case the permanent or temporary residence of the person to whom the Criminal Record Certificate is issued cannot be determined, the request shall be sent to the National Criminal Record Center. The written request must clearly state the address of the agency or organization, the purpose of using the Criminal Record Certificate, and information about the person to whom the Criminal Record Certificate is issued, as prescribed in Clause 1, Article 42 of this Law.

5. The Minister of Justice shall prescribe the form of the Application for issuance of a Criminal Record Certificate.

Thus, the procedure for requesting a criminal record certificate No. 1 for foreigners is carried out at the Department of Justice of the place of residence; in case the person has left Vietnam, it must be submitted to the National Center for Criminal Records.
